Terms of Use

1. About Seasonly

Seasonly is a mobile app operated by Aiden Tonyy ("we", "us", "our"). You can contact us at hello@seasonly.co.uk or by post at: Seasonly, The Catalyst, York Science Park, Baird Lane, York, YO10 5GA, GB.

The app provides a swipe-based platform that connects people seeking short-term seasonal work ("Job Seekers") with businesses that have seasonal hiring needs ("Employers"). Together, Job Seekers and Employers are "users" or "you".

By creating an account or using the app, you agree to these Terms and to our Privacy Policy, which explains how we handle your personal data.

2. Eligibility

To use Seasonly, you must:

  • be at least 18 years old;
  • have the legal capacity to enter into a binding contract;
  • not be prohibited from using the app under any applicable law; and
  • have received a valid invite code from us.

By using the app, you confirm that you meet these requirements. If you do not, you must not use Seasonly.

3. Accounts

3.1 Job Seeker accounts (invite only)

Job Seeker accounts are not open to public sign-up. We choose who is invited to join, and each Job Seeker needs a unique invite code from us to create an account. Invite codes are personal to the recipient and must not be shared or transferred. Keep yours confidential.

You are responsible for giving accurate, truthful and up-to-date information in your profile. An account can be either a Job Seeker or an Employer account, not both.

3.2 Employer accounts (invite only)

Employer accounts are not open to public sign-up. Each Employer needs a unique invite code from us to create an account. Invite codes are personal to the recipient and must not be shared or transferred. Keep yours confidential.

You are responsible for giving accurate, truthful and up-to-date information in your profile and job listings. An account can be either a Job Seeker or an Employer account, not both.

3.3 Account security

You are responsible for keeping your login details confidential and for all activity under your account. Tell us at hello@seasonly.co.uk as soon as you suspect unauthorised access.

3.4 One account per user

You may hold only one account. Creating duplicate or fraudulent accounts is not allowed.

4. Our role

Seasonly is a matching and communication platform. We are not an employer, a recruitment agency or a staffing business, and we are not a party to any employment, contract or other arrangement between a Job Seeker and an Employer. We do not direct, supervise or control any work done under such an arrangement.

Any arrangement that arises between a Job Seeker and an Employer is between those two parties only. We do not verify users' identities, qualifications or information, and we are not responsible for:

  • the accuracy or completeness of information provided by users;
  • the conduct, performance or suitability of any user;
  • the terms, pay, safety or legality of any work arrangement; or
  • any dispute between users.

Nothing in these Terms creates an agency, partnership or employment relationship between us and any user.

5. Job Seeker rules

As a Job Seeker, you agree to:

  • give honest, accurate and up-to-date profile information, including your identity, experience, qualifications and availability;
  • only upload a CV or other documents that are yours and that you have the right to share;
  • deal with Employers in good faith and respond to matches and messages professionally;
  • not apply for jobs you are not genuinely interested in or available for;
  • not misrepresent your identity, qualifications, right to work or availability; and
  • comply with the law in relation to your work search and any work arrangement.

6. Employer rules

As an Employer, you agree to:

  • give accurate and truthful information about your business and each job listing (including pay, hours, location and dates);
  • only post genuine, current and lawful job opportunities;
  • not use the platform to collect Job Seeker personal data for any purpose other than genuine recruitment for the listed role;
  • deal with matched Job Seekers in good faith and professionally;
  • comply with all employment, equality and data protection laws in your recruitment, including the Equality Act 2010, and not discriminate on the basis of any protected characteristic (including age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex and sexual orientation);
  • carry out your own right-to-work checks, background checks and any other pre-employment checks the law requires, independently of anything shared through the app;
  • keep your own records of those checks, because files sent in chat are automatically deleted (see section 11); and
  • not share, sell or use Job Seeker data obtained through the app for anything other than assessing candidates for the role they applied for.

Employers are independent data controllers of the personal information they receive about Job Seekers through the app.

7. Acceptable use

All users must not:

  • use the app for any unlawful purpose;
  • post content that is false, misleading, defamatory, obscene, offensive, harassing or discriminatory;
  • impersonate any person or organisation, or misrepresent their affiliation;
  • upload or transmit viruses, malware or other harmful code;
  • scrape, harvest or extract data from the app by automated means;
  • reverse-engineer, decompile or interfere with the app's code or infrastructure;
  • send spam or unsolicited commercial messages;
  • use the app in a way that unreasonably burdens our systems;
  • bypass any security or access control; or
  • threaten, abuse or harass other users.

We may remove content and suspend or terminate accounts that break these rules (see section 12).

8. Right to work and legal compliance

We do not verify anyone's right to work. Users may choose to send right-to-work documents or share codes to each other in chat, but that is a matter between those two users. We do not check or assess them, and we do not use them for any purpose beyond providing the chat feature. We accept no responsibility for whether any document is valid or sufficient.

Employers are solely responsible for:

  • carrying out right-to-work checks in accordance with the law and Home Office guidance;
  • keeping evidence of those checks for as long as the law requires; and
  • making sure anyone they engage has the legal right to work in the UK in the relevant capacity.

We do not carry out background checks, identity verification or any other pre-employment checks on Job Seekers beyond what users themselves choose to share.

9. Content and intellectual property

9.1 Your content

You keep ownership of the content you submit, including profile photos, bio, CV, job listings and messages. You give us a non-exclusive, worldwide, royalty-free licence to store, process, display and use that content as needed to operate, provide and improve the app, as described in our Privacy Policy. We do not claim ownership of it.

9.2 Content standards

Content you submit must not infringe anyone else's intellectual property or privacy rights, or break the law. You are responsible for the content you upload and share.

9.3 Our intellectual property

The app, its design, logo, code and content we create are owned by us and protected by intellectual property law. You may not copy, distribute, modify or create derivative works from them without our written permission.

10. AI matching

We use artificial intelligence, specifically vector embeddings generated via the OpenAI API, to rank and present job listings to Job Seekers and to rank applicants for Employers. Rankings are based on factors such as profile information, skills, experience, availability, location and stated preferences.

AI matching is a tool to help people find each other. It is not a guarantee of suitability, employability or a job. Employers make their own hiring decisions, and we do not guarantee any particular result or number of matches.

11. In-app chat

Once a match is confirmed, Job Seekers and Employers can message each other in the app. Please use chat professionally and lawfully.

Please be aware that:

  • Chat messages and attachments are not end-to-end encrypted. We do not routinely read them, but we may access them where needed to investigate a report, a safeguarding concern or a security issue, or where the law requires it.
  • Resolved chats stay visible in read-only mode to both parties.
  • Files sent in chat are automatically deleted 30 days after a match is marked as resolved. Save anything you need before then. Text messages are kept as described in our Privacy Policy.
  • Only share sensitive personal information in chat if it is reasonably necessary for the recruitment conversation. We are not responsible for how the other person uses what you share with them.

12. Suspension, termination and changes to the app

12.1 Closing your account

You can delete your account at any time in the app. This is permanent and cannot be undone. What happens to your data is explained in our Privacy Policy.

12.2 Our right to suspend or terminate

We may suspend or end your access to Seasonly if we reasonably believe you have:

  • broken these Terms;
  • given false or misleading information;
  • acted in a harmful, fraudulent or unlawful way; or
  • used the app in a way that could harm us or other users.

Where we can and it is appropriate, we will tell you by email why we have done so.

12.3 Changes to the app

We may change, suspend or discontinue the app or any feature at any time. Where reasonably possible, we will give notice of significant changes.

12.4 Effect of termination

When your account ends, your right to use the app ends. Terms that by their nature should continue (including sections 4, 8, 9, 13, 14 and 16) will continue to apply.

13. Disclaimers and limits on our liability

13.1 The app as provided

The app is provided "as is" and "as available". We do not promise it will be uninterrupted, error-free or free of harmful components. This does not affect your legal rights as a consumer (see section 13.4).

13.2 No guarantee of employment

We do not guarantee that using the app will lead to a match, a job offer or any work. Outcomes depend on the independent decisions of Job Seekers and Employers.

13.3 Limits on liability

To the extent the law allows, our total liability to you for claims arising from these Terms or your use of the app is limited to the greater of £100 or the total you have paid us in the 12 months before the claim (if any).

To the extent the law allows, we are not liable for:

  • indirect or consequential loss;
  • loss of profit, revenue, business, data or opportunity;
  • loss arising from your reliance on AI matching output;
  • loss arising from the conduct or content of other users;
  • loss arising from employment disputes or the failure of any work arrangement;
  • loss arising from a user's failure to comply with right-to-work requirements; or
  • loss arising from the app being interrupted or unavailable.

13.4 Your legal rights

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law. If you are a consumer, your statutory rights, including under the Consumer Rights Act 2015, are not affected.

14. Employer indemnity

If you are an Employer, you agree to compensate us for reasonable losses, costs and legal fees arising from:

  • your breach of these Terms;
  • content you submit to the app;
  • your breach of any law or third-party right; or
  • any employment or contractual dispute between you and a Job Seeker arising from a connection made through the app.

15. Changes to these Terms

We may update these Terms from time to time. We will change the "last updated" date and, for material changes, give reasonable notice in the app or by email before they take effect. If you do not accept the updated Terms, you must stop using the app and can delete your account.

16. Governing law and disputes

These Terms and any dispute arising out of or connected with them (including non-contractual disputes) are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your home courts.

We prefer to sort out disputes informally first. If you have a complaint, contact us at hello@seasonly.co.uk and we will try to resolve it.
